Medical malpractice can cause sweeping harm to victims and their families. One serious type of medical malpractice is a failure to diagnose which is why victims should understand what it includes and the legal protections that can help them with the harm they have suffered.

What is a failure to diagnose?

A failure to diagnose can include a failed diagnosis, misdiagnosis, delayed diagnosis or erroneous diagnosis. Each has the potential to serious harm victims. A failed or erroneous diagnosis can lead to the victim not receiving treatment for the medical condition they are suffering from. A misdiagnosis may not only result in the victim not receiving medical treatment for the medical condition they are suffering from but may also result in them receiving medical care and treatment for a medical condition they do not suffer from. Lastly, a delayed diagnosis can result in the victim not received the medical care and treatment they need when they need them.

What are the legal remedies for a failure to diagnose?

In circumstances when a failed diagnosis, misdiagnosis, delayed diagnosis or erroneous diagnosis leads to a worsened condition, the victim may be able to recover compensation for the harm they have suffered. A medical malpractice claim for damages can help victims recover compensation for their physical, financial and emotional harm suffered at the hands of a negligent medical care provider. It can also help hold the negligent medical care provider accountable. For that reason, victims of medical malpractice and their families should be familiar with legal protections that may be able to help them.
